Effective: April 1, 2025 – October 31, 2025
Upon commencement of this Service Agreement (the “Agreement”), Yardly (“the Contractor”) and the customer (“the Client”) agree as follows:
- 24-HOUR SATISFACTION GUARANTEE: Even though we take every measure to ensure your satisfaction with the initial service visit, if the Client finds any deficiencies, they must contact Yardly within twenty-four (24) hours of service completion. “Service completion” refers to when the Yardly Pro departs the property. If reported within 24 hours, and the issue is within scope, we’ll return at no charge. Otherwise, it will be addressed on the next visit.
- SCOPE: Yardly will perform services outlined in your Quote, between April 1 and October 31, 2025, governed by this Agreement.
- EVENT DEFINITIONS:
- Rainfall Event: 3+ mm of rain, ending after 3 dry hours.
- Nuisance Event: Lightning, sleet, or < 3 mm rain. Environment Canada records apply.
- SERVICE DEFINITIONS: Services listed in the Quote.
- SERVICE SCHEDULES:
- Spring: April 1 – April 30
- Summer: May 1 – September 30
- Fall: October 1 – October 31
Recurring mowing happens on scheduled weekdays. $10 rescheduling fee applies. No refunds for skipped visits. Clean-ups are weather-dependent, done within 3 days of the scheduled date. Visits may vary in time—no refunds for shorter visits.
- SERVICE NOTIFICATIONS: Yardly notifies Clients via email and text:
- Initial weekly notice
- 24-hour reminder with preparation tips
- Reschedule notifications
- Arrival notice (15–30 minutes prior)
- Completion confirmation with photos
Clients must keep contact info updated. Message/data rates may apply. Yardly follows CASL. Clients can change preferences anytime.
- INDIVIDUAL SERVICES: Billed per Quote, plus 5% GST. No minimum charge. Weather delays possible.
- UNIVERSAL SERVICE PACKAGE CONDITIONS: Rain delays may result in missed services. Yardly monitors weather data.
Clients must report hazards. Yardly not liable for unreported issues.
- WEED CONTROL AND FERTILIZATION: Takes up to 10 days. Reapplications available after that. Not for gardens. Extra removal: $75/hr (2-hr min).
- PET WASTE COLLECTION SERVICES (Add-On Only): Optional add-on service only. Unsafe/excessive conditions may void service.
Service Scope:
- Bagging waste from accessible turf, placed in your bin.
- Available as one-time or recurring add-on.
- Cost based on dog count and frequency.
Client Responsibilities:
- Secure pets
- Unlock/unblock gates
- Only firm waste in clear, accessible areas
Limitations & Exclusions:
- No loose or excessive waste
- Snow/ice/overgrowth may void service
- No wild animal waste
- Overage billed at $75/hr (2-hr min)
Missed or Rescheduled Visits:
- Weather-affected visits rescheduled
- Client faults (locked gate, pets) = no refund
- Return visits at hourly rate
Health & Safety Disclaimer: Yardly disclaims liability for health issues unless gross negligence occurs. Sanitation not included.
- SERVICE SPECIFICATIONS: Yardly avoids obstructions within 12”. Clients must report yard hazards. Yardly isn’t responsible for debris or unsafe conditions.
- DELAYS: Client issues (pets, gates) = skipped visit + $75/hr return (2-hr min).
- RETURN SERVICE CALLS: Must be requested within 24 hours. Valid claims addressed free. Invalid = $100 fee.
- EXTRA SERVICE REQUESTS: Must be submitted 12 hours in advance. Charged at $75/hr (2-hr min). Yardly may decline for weather/safety.
- TREE & STUMP SERVICES: Subject to quote and availability. Weather and regulations apply.
- Quotes provided within 2–4 business days
- Completion in 3–5 days post-approval
- Yardly may decline unsafe or unserviceable requests
- OVERGROWN GRASS: 6″+ grass = $75/hr surcharge, with prior notice.
- DEBRIS CLEANUP SERVICES: Clean-Up covers leaves, thatch, small branches. Excludes other debris.
- INSURANCE: $2M liability + auto insurance. Proof available upon request.
- LIABILITY: Yardly only liable for its actions. Clients indemnify Yardly for external claims.
- FORCE MAJEURE: Yardly not liable for delays due to acts of God, weather, or legal limitations.
- PRIVACY: Personal info used only for service. Handled per Alberta or federal privacy laws.
- PAYMENT TERMS: Schedule per Quote. Deposit required. Late accounts suspended after 7 days.
- SENIOR DISCOUNT: 10% for age 65+. Requires ID. Non-transferable. Verified at Yardly’s discretion.
- AUTOMATIC RENEWAL OF SERVICES: Auto-renews unless opted out. 30-day advance notice provided. Clients must update contact info.

- CANCELLATION & TERMINATION: 7-day notice required. $50 fee for short-notice cancellations. Prorated refunds. Subject to Alberta’s Consumer Protection Act.
- DISPUTE RESOLUTION: Mediation in Alberta before legal action. Governed by Alberta law.
- INTEGRATION & SEVERABILITY: Supersedes past agreements. Invalid clauses do not void rest of contract.
